Terms of Service

Legal

1. Scope and Subject Matter of the Contract

These General Terms and Conditions (ToS) of Montazeri Ventures GmbH, Dresdner Straße 12, 69181 Leimen, Germany (hereinafter "Provider" or "we") apply to the use of the Software-as-a-Service platform "Airtape" (hereinafter "Platform" or "Software"), accessible at airtape-web.fly.dev or associated domains.

Deviating ToS of the user are not recognized unless the Provider explicitly agrees to their validity in writing.

2. Services of the Platform

Airtape offers a web-based solution for local and uncompressed recording of audio and video tracks for podcasts and remote interviews. The tracks of the individual participants are recorded locally in their browsers, uploaded to the Provider's cloud, and made available there for the host to download.

Product Status:Airtape may offer free features, paid features, and beta features at the same time. We reserve the right to adapt, expand, limit, or discontinue features at any time. Beta and preview features may be unavailable, incomplete, or changed without notice, and there is no claim to uninterrupted availability or error-free operation for such features.

3. Registration and User Account

To create sessions (as a "host"), registration is required. Registration is generally not necessary for pure guests ("Guests"); they enter the room via a link generated by the host.

The user assures that the information provided by them during registration is truthful and complete. The user is obliged to keep their access data (password) secret and protect it from access by unauthorized third parties.

4. User Obligations and Responsibilities

The user is solely responsible for all content (audio, video, chat) that they or their guests record or transmit via the platform.

The user undertakes not to use the platform for unlawful purposes. In particular, it is prohibited to:

  • Record or distribute content that violates copyrights, trademark rights, or other intellectual property rights of third parties.
  • Record individuals without their express, prior, and demonstrable consent.
  • Create or share glorifying violence, extremist, racist, or pornographic content.
  • Disrupt the technical infrastructure of the platform through hacking, spamming, or virus distribution (prohibition of misuse).

The provider reserves the right to block accounts immediately in the event of violations of these obligations and to delete unlawful content (sessions) immediately and without prior notice.

5. Rights of Use to the Recordings

All intellectual property rights to the recordings created via Airtape remain entirely with the user or the respective creators (Hosts/Guests).

The user only grants the provider the non-exclusive rights, limited in space and time to the duration of the contract fulfillment, to store, technically process (merging the local "chunks"), reproduce, and make available for download the data (video/audio), as far as this is technically necessary for the operation of Airtape.

6. Subscriptions, Credits and Billing

Airtape offers Free, Creator, and Studio plans with the recording-minute, participant, and retention limits displayed on the pricing page and before checkout. Paid plans are offered with monthly or annual billing. The recurring price, billing interval, and applicable taxes are shown before you place the order.

Paid subscriptions automatically renew for the selected monthly or annual billing interval until canceled. You can manage or cancel a paid subscription through the billing portal in account settings. Cancellation takes effect at the end of the current billing period, and access to the paid plan continues until then, unless applicable law requires otherwise.

Transcription runs only when you explicitly request it. Paid plans include a monthly transcription allowance (Creator 60 minutes, Studio 240 minutes); one credit covers two minutes of audio. The included allowance resets each billing period and unused minutes do not roll over; it is used before purchased credits. Usage beyond the allowance and other designated tools consume separately purchased credits, which do not expire. Credits are non-transferable, not redeemable for cash, and may be reserved before processing; a failed job may return reserved credits to your balance.

Except where required by applicable law, completed credit purchases and subscription charges are non-refundable. Statutory cancellation, withdrawal, and refund rights remain unaffected. Chargebacks, fraud, abuse, or violations of these ToS may lead to suspension of your account, reversal of credits, or termination of access.

7. AI Features and Transcript Limitations

If you choose to use Airtape's AI features, you instruct us to process the relevant recording data for the requested output. Transcription is currently processed by Airtape's self-hosted software on server infrastructure provided by Hetzner. You must ensure that you have all necessary rights, notices, and consents to submit the audio or video for transcription or other AI processing.

AI-generated transcripts may contain errors, omissions, hallucinations, incorrect speaker attribution, or formatting problems. Airtape does not warrant the factual, editorial, or legal accuracy of transcript output. You remain solely responsible for reviewing and verifying any transcript before publishing, sharing, or relying on it.

8. Warranty and Limitation of Liability

The platform is provided on an "as is" and "as available" basis to the extent permitted by law. We do not guarantee uninterrupted availability of the platform or absolute error-free recordings, transcripts, or AI outputs.

Liability for Data Loss:No recording system can eliminate every risk of data loss, aborted sessions, or synchronization errors. The user is strongly advised to operate an independent backup system (for example, a local audio recorder) in parallel for irreplaceable recordings.

You remain solely responsible for maintaining your own backups and for independently reviewing any recording, transcript, summary, or AI-generated output before use, publication, distribution, or reliance.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or lost profit damages, including loss of business, loss of goodwill, loss of revenue, loss of data, failed recordings, inaccurate transcripts, or decisions made in reliance on AI-generated output.

The provider's liability for damage to the user caused by simple negligence is excluded. Excepted from this is liability for damages resulting from injury to life, body, or health as well as liability for the breach of essential contractual obligations (cardinal obligations). In these cases, however, liability is limited to the contract-typical, foreseeable damage.

9. Term, Termination and Data Deletion

The account agreement continues until the account is deleted. Paid subscriptions renew for the selected billing interval until canceled and can be canceled through the billing portal; cancellation becomes effective at the end of the current billing period. Deleting an account does not limit any mandatory statutory retention duties for invoices and payment records.

Deleting a session or account removes associated recordings, chunks, and service metadata from active systems, subject to technically necessary backup cycles and legally required retention. Recordings are also automatically deleted after the active plan's 7-, 30-, or 90-day retention period. Download recordings you need to retain before deletion or a plan downgrade takes effect.

10. Changes to the ToS

The provider may amend these ToS with effect for the future where there is a valid reason and the change is reasonable for the user. Material changes will be communicated in advance by email or when logging in. Mandatory consumer rights remain unaffected.

11. Final Provisions

The law of the Federal Republic of Germany applies under exclusion of the UN Sales Convention. If the user is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes from usage relationships is the seat of the provider (Mannheim).

Should individual provisions of these ToS be or become ineffective, the effectiveness of the remaining provisions remains unaffected.
